Article 1. Seller identification

These general terms and conditions of sale (the "Terms") apply to sales concluded on the website show-time.shop (Showtime store), operated by:

OVERVIEW SAS, a société par actions simplifiée (French simplified joint-stock company) with share capital of EUR 2,000, whose registered office is at 47 rue Vivienne, 75002 Paris, France, registered with the Paris Trade and Companies Register under number 104 986 039, represented by Claudette Laprun, President.

Article 2. Scope

These Terms govern the distance sale of artworks (paintings, drawings, prints, lithographs, sculptures, editions and art objects) offered on the website, between OVERVIEW SAS and any buyer, whether a consumer or a professional. They prevail over any other document. The buyer declares having read and accepted them before placing an order. The applicable Terms are those in force on the date of the order.

Article 3. The artworks

Each artwork is described with the greatest care: artist, title, date, technique, dimensions, type of edition (unique piece, limited edition, open edition), and whether or not it is framed. The photographs are as accurate as possible. Slight colour differences may nevertheless exist depending on the screen used.

Most artworks are unique pieces or numbered copies available as a single copy. An artwork may be sold through another channel between the time it is put online and the validation of the order. In that case, OVERVIEW SAS informs the buyer and refunds all amounts paid in full.

When a certificate of authenticity accompanies the artwork, this is stated on the product page.

Some artworks are offered "price on request". They cannot be ordered online. Interested buyers should write to contact@show-time.shop.

Article 4. Prices

Prices are stated in euros, including all taxes (TTC), excluding delivery costs. Delivery costs are shown before the order is validated.

Margin scheme, second-hand goods (art. 297 A CGI).

For deliveries outside the European Union, any customs duties, import taxes and customs clearance fees are payable by the buyer. They are not included in the price.

OVERVIEW SAS may change its prices at any time. The artwork is invoiced at the price in force at the time the order is validated.

Article 5. Order

The buyer selects one or more artworks, checks the contents of the cart, enters their contact details and delivery address, chooses a payment method, and then validates the order after accepting these Terms. The order becomes final once payment is confirmed. A confirmation email summarising the order is sent to the buyer.

OVERVIEW SAS reserves the right to refuse or cancel an order in the event of an existing dispute with the buyer, suspected fraud or unavailability of the artwork.

Article 6. Payment

Payment is due upon ordering. It is made online via Shopify Payments, by bank card, Apple Pay, Shop Pay or PayPal, depending on the methods offered at the time of payment. Payments are processed securely by the payment service providers. OVERVIEW SAS never has access to full bank card details.

Article 7. Delivery

Artworks are delivered to the address provided by the buyer, in the countries served listed in the shipping policy, which sets out the zones and rates.

Shipping times, carriers and tracking arrangements are set out in the shipping policy.

In accordance with Article L216-1 of the French Consumer Code, if no date is stated, the artwork is delivered no later than 30 days after the conclusion of the contract. Risk passes when the buyer, or a third party designated by the buyer, takes physical possession of the artwork (Article L216-4 of the French Consumer Code).

The buyer is asked to check the condition of the parcel upon receipt and to report any anomaly (damaged parcel, damaged artwork) in writing to the carrier and to contact@show-time.shop as soon as possible, with supporting photographs.

For some artworks shipped outside the European Union, a cultural goods export certificate or an export licence may be required depending on the age and value of the artwork.

Article 8. Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, a consumer buyer has 14 days from receipt of the artwork to exercise the right of withdrawal, without having to give reasons or pay any penalty.

To exercise it, the buyer notifies their decision by an unambiguous statement sent to contact@show-time.shop, or by using the model form set out in the appendix.

The artwork must be returned no later than 14 days after notification of the withdrawal, in its original condition, in its original packaging or packaging offering equivalent protection, with its accessories and documents (certificate, invoice).

It is strongly recommended to insure the parcel for the value of the artwork.

OVERVIEW SAS refunds all amounts paid, including the initial delivery costs (up to the standard delivery rate), no later than 14 days after being informed of the withdrawal. It may withhold the refund until it has received the artwork back or until proof of shipment has been provided. The refund is made using the same payment method as the one used for the order.

The buyer may be held liable for any diminished value of the artwork resulting from handling other than what is necessary to establish its nature, characteristics and functioning.

The right of withdrawal does not apply to artworks made to the buyer's specifications or clearly personalised (Article L221-28 of the French Consumer Code). Nor does it apply to professional buyers.

The practical arrangements are detailed in the return and refund policy.

Article 9. Legal guarantees

Independently of any commercial guarantee, OVERVIEW SAS remains bound by the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

Legal guarantee of conformity

The consumer has a period of two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity and not the date on which it appeared.

The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to keep the goods in conformity.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience to the consumer.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if:

  1. the professional refuses to repair or replace the goods;
  2. the repair or replacement of the goods takes place after a period of thirty days;
  3. the repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
  4. the lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. In that case, the consumer is not required to request repair or replacement of the goods first.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the restored goods are delivered.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who in bad faith obstructs the application of the legal guarantee of conformity is liable to a civil fine of up to EUR 300,000, which may be increased to up to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in exchange for returning the goods.

Any claim under the legal guarantees should be sent to contact@show-time.shop.

Article 10. Ownership

The artworks remain the property of OVERVIEW SAS until the price has been paid in full. The purchase of an artwork does not entail any assignment of copyright, which remains with the artist or their successors in title.

Article 11. Personal data

Data collected when an order is placed is processed in accordance with the privacy policy.

Article 12. Complaints and mediation

Any complaint may be sent to contact@show-time.shop. OVERVIEW SAS undertakes to respond as soon as possible.

In accordance with Articles L611-1 et seq. and R612-1 et seq. of the French Consumer Code, a consumer buyer may use a consumer mediator free of charge, after having attempted to resolve the dispute directly through a written complaint to OVERVIEW SAS:

The contact details of the consumer mediator to which OVERVIEW SAS is subject are available on request at contact@show-time.shop.

Article 13. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, and failing an amicable settlement or resolution through mediation, the French courts have jurisdiction, subject to the mandatory rules of jurisdiction applicable to consumers.
